What lies behind the hatred for the PT? (I)

It is a dreadful fact, if an analytically explicable one: the rise of hatred and anger against the PT, (from the Portuguese, Partido dos Trabalhadores, Worker’s Party). This phenomenon is the other side of Brazilian “cordiality”, as suggested by Sergio Buarque of Holland: from the same heart where warm welcoming is born also comes the most violent rejection. Welcome and rejection are both “cordial” – the two passionate faces of Brazilians.

That hatred is fed by the conservative mass media and by those who do not respect the democratic rite of elections: one either wins or loses. The one who loses graciously accepts defeat and the winner shows magnanimity to the vanquished. But this civilized behavior did not prevail. To the contrary: the defeated are seeking by all possible means to deny legitimacy to the victor, and ensure a policy change that follows their proposals, which were rejected by the majority of the electorate.

There is no better way to understand this than to visit the remarkable historian Jose Honorio Rodrigues, whose thoughts expressed in his classic Conciliação e Reforma no Brasil (1965), sound like something spoken today:

«The ruling class, defeated at the ballot box and out of power, are not just indignant, but have become intolerant; they devised a conspiratorial concept of history that in order for their minority forces to attain an unexpected and unforeseen success, the intervention of hatred, intrigue, impiety, resentment, intolerance, intransigence, and indignation was indispensable.» (p. 11).

Those groups are perpetuating the old elites, that from Colonial times up to the present have not changed their ethos. In the words of the same author: «the majority was always alienated, anti-nationalist and not contemporary; it never reconciled with the people; denied their rights, devastated their lives and when it saw it was growing, little by little it withdrew its approval, and conspired to return it to the periphery, where the elites continue to believe the people belong» (p.14 and 15). Today the economic elites detest the people. The elites only accept the people as they are stereotyped in the carnival.

Sadly, it never enters their heads that «the most important accomplishments are fruits of racial interbreeding that created a type well adapted to the country, the cultural interchange that created a new synthesis; the racial tolerance that prevented going back on their accomplishments; the religious tolerance that made impossible or difficult the persecutions of the Inquisition; the territorial expansion, the work of the mamelucos, since Domingos Jorge Velho himself, the invader who incorporated the Piaui, did not speak Portuguese; the psychosocial integration that eliminated prejudices and created a sense of national solidarity; the territorial integrity; the unity of language, and finally, the riches and wealth of Brazil that are the fruits of the labor of the people. And what did the later colonial leaders do? They did not even give the Brazilian people health and educational benefits» (p. 31-32).

Why are those quotes mentioned? They reinforce an undeniable historical fact: with the PT, those who were previously deemed fuel in the process of production (Darcy Ribeiro), the social wretches, managed through a painful trajectory to organize themselves into a social power that became a political power in the PT, and conquered the apparatus of the State. They removed the dominant classes from power; not just as an alternation of the reins of power, but a change of social class, the basis for different type of politics. It is the equivalent of a true social revolution.

That is unacceptable to the powerful classes that were used to making the State their natural home and to privately appropriating the public goods through the infamous patrimonial system, denounced by Raymundo Faoro.

Through any means or tricks they now want to again occupy that position they consider to be rightfully theirs. They surely have began to realize that perhaps they will never again see the historical conditions needed to reclaim their position of domination and conciliation. A different type of political history will finally give Brazil a different destiny.

To them, the path of the ballot box has turned out to be ineffective, thanks to the critical numbers attained by a wide strata of people who rejected their policy of neoliberal alignment with the process of globalization, as dependant and assimilated partners. The military path is now impossible, given the changes in the framework. They fantasize about the possibility of judicializing politics, counting on Supreme Court allies who harbor the same hatred for the PT and the same disdain for the people.

Through this expedient, they could impeach the first Brazilian woman head of state. This is a conflictive path because the national voice of the social movements would make this a risky and perhaps impossible move.

The hatred for the PT is not so much against the PT as directed at the poor, who, thanks to the PT and its politics of social inclusion, have been lifted from the hell of poverty and hunger, and now occupy the place previously reserved for the well-to-do elites. The well-to-do think only of performing charity, of donating used items, but they never ever thought of seeking social justice.

I anticipate the critics and the moralists: but has the PT became corrupt? Look at the mensalon, look at Petrobras. I do not defend corruption. I acknowledge, lament and reject the bad dealings of a few leaders. They primarily betrayed more than a million followers and wasted the ideals of ethics and transparency. But in the bases and in the municipalities –I can give testimony of this– a different way of politics is practiced, with popular participation, showing that such a generous dream, the dream of a less perverse Brazil, is not easily killed that way. The upper classes, over 500 years, in the strong words of Capistrano de Abreu, «castrated and re-castrated, neutered and re-neutered» the Brazilian people. Is there a greater historical corruption than that? We will return to this theme.

Una experiencia de choque: el encuentro con José Mujica

Participando en un congreso iberoamericano sobre Medicina Familiar y Comunitaria, que tuvo lugar en Montevideo del 18-22 de marzo, tuve la oportunidad siempre deseada de encontrarme con el expresidente de Uruguay José Mujica. Finalmente fue posible el día 17 de marzo hacia las 4 de la tarde. Tal encuentro se dio en su pequeña finca, en los alrededores de la capital Montevideo.

Encontramos a una persona que al verla y oírla nos remite inmediatamente a figuras clásicas del pasado, como Leon Tolstoi, Mahatma Gandhi, Chico Mendes e incluso Francisco de Asís. Ahí estaba él con su camisa sudada y rasgada por el trabajo en el campo, con un pantalón de deporte muy usado y sandalias que dejaban ver unos pies polvorientos, como quien viene de trabajar en la tierra. Vive en una casa humilde y a un lado el viejo cochecito que no anda a más de 70 km por hora. Le han ofrecido un millón de dólares por él; rechazó la oferta por respeto al viejo coche que lo llevaba diariamente al palacio presidencial y por consideración al amigo que se lo regaló.

Rechaza que lo consideren pobre. Dice: “no soy pobre, porque tengo todo lo que necesito para vivir. Pobre no es no tener, es estar fuera de la comunidad y yo no lo estoy”.

Formó parte de la resistencia a la dictadura militar. Vivió trece años en prisión y un buen tiempo dentro de un pozo, cosa que le dejó secuelas hasta el día de hoy. Pero nunca habla de eso ni muestra el más mínimo resentimiento. Comenta que la vida le hizo pasar por muchas situaciones difíciles, pero todas fueron buenas para darle sabias lecciones y ayudarle a crecer.

Charlamos más de hora y media. Empezamos por la situación de Brasil y de América Latina en general. Se mostró muy solidario con Dilma especialmente con su determinación de hacer una investigación rigurosa y castigar adecuadamente a los corruptos y corruptores del penoso caso de Petrobrás. No dejó de señalar que hay una política orquestada desde Estados Unidos para desestabilizar gobiernos que intentan realizar un proyecto de país autónomo. Eso está ocurriendo en el norte de África y puede estar también en curso en América Latina y en Brasil, siempre en articulación con los sectores más acomodados y poderosos de dentro del país, que temen cambios sociales que pueden amenazar sus privilegios históricos.

Pero la gran conversación fue la situación del sistema-vida y del sistema-Tierra. Ahí me di cuenta del amplio horizonte de su visión de mundo. Enfatizaba que la cuestión central hoy no es la preocupación por Uruguay, su país, ni por nuestro continente latinoamericano, sino por el destino de nuestro planeta y el futuro de nuestra civilización. Decía, entre meditabundo y preocupado, que tal vez tengamos que presenciar grandes catástrofes hasta que los jefes de estado se den cuenta de la gravedad de nuestra situación como especie y tomen medidas salvadoras. En caso contrario, vamos al encuentro de una tragedia ecológico-social inimaginable.

Lo triste, comentaba Mujica, es percibir que entre los jefes de estado, especialmente los de las grandes potencias económicas, no se advierte ninguna preocupación por crear una gestión plural y global del planeta Tierra, ya que los problemas son planetarios. Cada país prefiere defender sus derechos particulares, sin darse cuenta de las amenazas generales que pesan sobre la totalidad de nuestro destino.

Mas el punto álgido de la conversación, sobre el cual pretendo volver, fue sobre la urgencia de crear una cultura alternativa dominante a la cultura del capital. De poco vale, subrayaba, que cambiemos el modo de producción, de distribución y de consumo si seguimos manteniendo los hábitos y “valores” vividos y proclamados por la cultura del capital. Esta tiene aprisionada a toda la humanidad con la idea de que necesitamos crecer de forma ilimitada y buscar un bienestar material sin fin. Esta cultura opone a ricos y pobres. E induce a los pobres a buscar ser como los ricos. Agiliza todos los medios para que se hagan consumidores. Cuanto más insertados están en el consumo más demandas hacen, porque el deseo inducido es ilimitado y nunca sacia al ser humano. La pretendida felicidad prometida se desvanece en una gran insatisfacción y vacío existencial.

La cultura del capital, acentuaba Mujica, no puede darnos felicidad, porque nos ocupa totalmente con el ansia de acumular y de crecer, no dejándonos tiempo de vida para simplemente vivir, celebrar la convivencia con los otros y sentirnos parte de la naturaleza. Esa cultura es anti-vida y anti-naturaleza, devastada por la voracidad productivista y consumista.

Importa vivir lo que pensamos, de lo contrario pensamos como vivimos: la espiral infernal del consumo incesante. Se impone la sencillez voluntaria, la sobriedad compartida y la comunión con las personas y con toda la realidad. Es difícil, constataba Mujica, construir las bases para esta cultura humanitaria y amiga de la vida. Y tenemos que empezar por nosotros mismos.

Le comenté: “usted nos ofrece un vivo ejemplo de que eso es posible y está en el ámbito de las virtualidades humanas”.

Al final, abrazándonos fuertemente, le comenté: “lo digo con sinceridad y con humildad: veo que hay dos personas en el mundo que me inspiran y me dan esperanza: el Papa Francisco y Pepe Mujica”. No dijo nada. Me miró profundamente y vi que sus ojos enmudecieron de emoción.

Salí del encuentro como quien ha vivido un choque existencial que le hace bien: me confirmó en aquello que con muchos otros pensamos y procuramos vivir. Y agradecí a Dios por habernos dado una persona con tanto carisma, tanta sencillez, tanta entereza y tanta irradiación de vida y de amor.

Delação premiada: um questionamento jurídico-ético

João Baptista Herkenhoff é um conhecido magistrado do Espírito Santo, comprometido com os direitos humanos, especialmente, na época da ditadura militar, um estudioso e autor de livros jurídicos. As reflexões que aqui propõe nos ajudam a pensar o que significa a delação premiada feita por verdadeiros crimonosos e ladrões (como no caso da Petrobrás) que, na opinião de alguns vem considerados falsamente como heróis. Este texto nos ajuda a fazer um juízo mais matizado e sereno à luz de valores éticos. LBoff

A delação premiada está na ordem do dia, em razão de fatos que ocupam o noticiário. Entretanto este texto não está focado nas circunstâncias do momento. Neste artigo trato da delação premiada, sob o ângulo ético e doutrinário. As reflexões baseadas na Ética e na Doutrina têm valor permanente, ou seja, valem para o presente, valeram para o passado e valerão para o futuro.

Com uma ressalva que registro no final, não vejo com simpatia o instituto jurídico da delação premiada.
Introduzida há poucos anos no Direito brasileiro, a delação premiada de muito tempo é utilizada em países como Estados Unidos, Alemanha e Itália. O fato de ser adotada em nações poderosas não aconselha a imitação porque cada país tem sua história, seus valores, o direito de traçar seu caminho.

A meu ver, a delação premiada associa criminosos e autoridades, num pacto macabro.
De um lado, esse expediente pode revelar tessituras reais do mundo do crime.
Numa outra vertente, a delação que emerge do universo criminoso, quando falsa, é injusta e pode enredar, como vítimas, justamente aquelas pessoas que estejam incomodando o crime.

Na maioria das situações, creio que o uso da delação premiada tem pequena eficácia, uma vez que a prova relevante, no Direito Penal moderno, é a prova pericial, técnica, científica, e não a prova testemunhal, e muito menos o testemunho pouco confiável de pessoas condenadas pela Justiça.

Ao premiar a delação, o Estado eleva ao grau de virtude a traição. Em pesquisa sócio-jurídica que realizamos, publicada em livro, constatei que, entre os presos, o companheirismo e a solidariedade granjeiam respeito, enquanto a delação é considerada uma conduta abjeta (Crime, Tratamento sem Prisão, Livraria do Advogado, de Porto Alegre, página 98).

Então, é de se perguntar: pode o Estado ter menos ética do que os cidadãos que o Estado encarcera? Pode o Estado barganhar vantagens para o preso em troca de atitudes que o degradam, que o violentam, e alcançam, de soslaio, a autoridade estatal?

A tudo isso faço apenas uma ressalva. Merece abrandamento da pena ou mesmo perdão judicial aquele que, tendo participado de um crime (sequestro de uma pessoa, por exemplo), desiste de seu intento no trajeto do crime e fornece às autoridades informações que permitam (no exemplo que estamos citando) a localização do sequestrado e o consequente resgate da vida em perigo. Numa hipótese como essa, o arrependimento do criminoso tem a marca da nobreza e o Estado, premiando sua conduta, age eticamente.

Auf Aggression durch die Menschen antwortet die Erde mit Blumen

 Abgesehen davon, dass wir uns schon inmitten einer Krise von globalem Ausmaß befinden, haben wir es nun mit einem irreversiblen Vorgang zu tun. Die Erde wird nie wieder dieselbe sein. Ihre physikalisch-chemisch-ökologische Basis wurde auf solch tief greifende Weise verändert, dass sie ihr inneres Gleichgewicht verlor. Sie ist in einen chaotischen Prozess eingetreten, d. h. sie hat ihre Nachhaltigkeit verloren, was die Kontinuität dessen, was sie Jahrtausende lang getan hat, beeinflusst: Leben zu produzieren und zu reproduzieren.

 Jedes Chaos hat zwei Seiten: eine destruktive und eine kreative. Die destruktive Seite ist die Störung einer Art von Gleichgewicht, was im Schwinden von Teilen der Artenvielfalt resultiert und schließlich auch der menschlichen Spezies, bedingt entweder durch deren Unfähigkeit, sich der neuen Situation anzupassen, oder seiner Unfähigkeit, seine tödlichen Auswirkungen abzuschwächen. Am Ende dieses Reinigungsprozesses wird das Chaos beginnen, seine generative Seite zu zeigen. Es wird neue Ordnungen herstellen, das Klima stabilisieren und den Menschen, denen es gelungen ist zu überleben, ermöglichen, eine neue Art von Zivilisation zu errichten.

 Die Geschichte der Erde zeigt uns, dass sie ungefähr fünfzehn große Zerstörungen erlebt hat, wie z. B. das Kambrium vor 480 Millionen Jahren, das 80-90 % aller Spezies zerstörte. Doch seitdem ist die Erde wie eine großzügige Mutter und baute allmählich die Artenvielfalt wieder auf.

 Heutzutage warnt uns eine große Mehrheit der wissenschaftlichen Community vor einem möglichen Kollaps des Lebenssystems, der tatsächlich die Zukunft der menschlichen Spezies bedrohen könnte. Wir alle können diese Veränderungen wahrnehmen, die sich vor unseren Augen abspielen. Große Extreme erscheinen: auf der einen Seite verlängerte Sommer in Verbindung mit großem Wassermangel, der das Ökosystem und die Gesellschaft als Ganze beeinträchtigt, wie es im Südosten Brasiliens geschieht. In anderen Teilen des Erdballs, wie in den Vereinigten Staaten, gibt es extreme Winter, wie man sie seit Jahrzehnten oder sogar Jahrhunderten nicht mehr erlebt hat.

 Tatsache ist, dass wir die physikalischen Grenzen des Planeten Erde erreicht haben. So wie wir diese Grenzen zu überschreiten, wie es durch unsere Produktivität und Konsumgier geschieht, antwortet die Erde mit Orkanen, Tsunamis, verheerenden Fluten, Erdbeben und mit einer irreversiblen globalen Erwärmung. Wenn wir die Temperatur um zwei verheerende Grad Celsius erhöhen, könnte die Situation immer noch handhabbar sein. Doch wenn wir das nicht tun, was nötig ist, nämlich den Ausstoß von Treibhausgasen drastisch zu reduzieren, und unser Verhältnis mit der Natur nicht neu-orientieren hin zu einer kollektiven Selbst-Beschränkung, und die Belastungsgrenzen jedes Ökosystems respektieren, ist ein Anstieg von 4-6 Grad Celsius wahrscheinlich. Dann werden wir die „Qual der Verwüstung“ erleiden, um einen biblischen Ausdruck zu benutzen, und ein großer Teil der Lebensformen, wie wir sie kennen, einschließlich Teile der Menschheit, werden das nicht überstehen können.

 Am 15. Januar 2015 veröffentlichte die bekannte Zeitschrift Science den Artikel „Natürliche Grenzen: Die Entwicklung der Menschen auf einem sich verändernden Planeten lenken“, der von 18 Wissenschaftlern über die Grenzen des Planeten erarbeitet wurde. Diese Wissenschaftler erkannten neun Dimensionen, die den Fortbestand des Lebens und unseren Zivilisationsversuch grundlegend herausfordern. Es lohnt sich, sie aufzuzählen: 1. Klimawandel; 2. Veränderungen der Unversehrtheit der Biosphäre mit dem Schwinden der Artenvielfalt und der beschleunigten Auslöschung von Spezies; 3. Ausdünnung der stratosphärischen Ozonschicht, die uns vor den schädlichen Sonnenstrahlen schützt; 4. die wachsende Übersäuerung der Meere; 5. die Unterbrechung der biologisch-geologisch-chemischen Flüsse (die Zyklen des Phosphors und des Stickstoffs, die für das Leben von fundamentaler Bedeutung sind); 6. solche Veränderungen in der Bodennutzung wie die wachsende Rodung der Wälder und die Verwüstung; 7. die bedrohende Verknappung des Trinkwassers; 8. die Konzentration der Treibgase in der Atmosphäre (mikroskopische Partikel, die das Klima und Lebewesen beeinträchtigen); und 9. die Einführung von synthetischen chemischen Wirkstoffen, radioaktivem Material und Nano-Materialien, die das Leben bedrohen.

 Von diesen neun Dimensionen haben die ersten vier bereits ihre Grenzen überschritten, und die anderen befinden sich in einem fortgeschrittenen Verfall-Zustand. Dieser systematische Krieg gegen Gaia kann sie zum Kollaps führen, so wie es mit Menschen geschieht.

 Und trotz dieser dramatischen Lage schaue ich mich um und sehe voller Entzückung den Wald voller Cuaresmeiras, violette Frühlingsbäume, gelbe Casias und an der Ecke meines Hauses blühende Amaryllis Belladonnas, Tukane auf den Bäumen, wenn ich aus dem Fenster sehe, und die Araras, die unter dem Dach ihre Nester bauen.

 Dann erkenne ich, dass die Erde eine wirklich großzügige Mutter ist: auf unsere Aggressionen lächelt sie immer noch mit Flora und Fauna zurück. Und sie gibt uns die Hoffnung, dass es nicht die Apokalypse, sondern eine neue Genesis ist, was kommt. Die Erde wird überleben. Wie die jüdisch-christlichen Schriften uns zusichern: „Gott ist der souveräne Liebhaber des Lebens“ (Weish. 11,26). Und Gott wird nicht zulassen, dass das Leben verschwindet, nachdem es das Chaos so schmerzhaft überwand.
